1. Parties
This Platform is operated by Metz Octagon Engineering LTD, a company incorporated under the laws of the Republic of Türkiye, with registered address at İSTASYON MAH. YARIŞ ÇIKMAZI SK. NO: 1 İÇ KAPI NO: 173 TUZLA/ İSTANBUL and registration number [Number].
These Terms apply exclusively to business customers (B2B). By placing an order, the customer confirms that it is acting in the course of business.
2. Nature of Services
The Company provides on-demand manufacturing services including but not limited to:
- CNC machining
- Polymer/Metal 3D printing
- Mold manufacturing
- Prototype and model production
For polymer 3D printing, an automated quotation system may generate instant pricing.
For other manufacturing methods, quotations are provided manually.
All products are custom-manufactured based on customer-supplied designs.
3. Formation of Contract
A binding agreement is formed only when:
- The Company confirms the order in writing, and
- Payment terms are fulfilled as agreed.
Automated price calculations are non-binding until order confirmation.
4. Customer Responsibilities
The customer warrants that:
- It owns or has full rights to manufacture the submitted designs.
- The design does not infringe any third-party intellectual property.
- The design is technically suitable for its intended application.
- The parts comply with all applicable regulations in the country of use.
The Company does not perform functional validation, structural analysis, or regulatory compliance verification unless explicitly agreed in writing.
5. Testing, Certification & Regulatory Compliance
Unless otherwise agreed in writing:
- The customer is solely responsible for product testing, validation, certification, and regulatory compliance.
- The Company does not guarantee conformity with CE, RoHS, REACH, medical, aerospace, automotive, or other regulated standards.
Upon request, the Company may provide manufacturing documentation or material data sheets where available.
Additional certification or testing services may be offered separately subject to quotation.
6. Manufacturing Tolerances & Technical Limitations
All parts are produced according to industry-standard tolerances unless otherwise agreed.
For polymer 3D printing:
- Layer lines and surface variations are inherent.
- Mechanical properties may vary depending on orientation.
- Minor cosmetic deviations do not constitute defects.
Material behavior such as shrinkage, warping, or anisotropy is inherent to manufacturing processes.
Unless specifically agreed, no guarantee is given regarding mechanical performance under load.
7. Custom Production & Returns
All products are custom-manufactured to customer specifications.
Therefore:
- Orders cannot be canceled once production has started.
- Custom parts are non-returnable and non-refundable.
Claims for manufacturing defects must be submitted within 7 days of delivery with documented evidence.
If a verified manufacturing defect exists, the Company may, at its discretion:
- Remanufacture the part, or
- Issue a partial or full refund limited to the order value.
No returns are accepted for design errors, incorrect specifications, or improper use.
8. Pricing & Payment
Prices are exclusive of VAT unless otherwise stated.
The Company reserves the right to correct pricing errors prior to order confirmation.
Production begins only after payment is received unless otherwise agreed.
9. Delivery & Risk Transfer
Delivery times are estimates and not binding.
Risk transfers to the customer upon dispatch of goods.
The Company is not liable for shipping delays, customs issues, or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for indirect, incidental, or consequential damages.
- The Company shall not be liable for loss of profit, loss of production, or third-party claims.
- Total liability is limited to the amount paid for the specific order.
11. Intellectual Property & Confidentiality
All designs remain the property of the customer.
The Company may use subcontractors under confidentiality obligations.
The Company reserves the right to retain anonymized production data for quality and internal process improvement.
12. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the Republic of Türkiye.
Disputes shall be resolved exclusively by the competent courts of Istanbul, Türkiye.
